The Copyright Question

I've been wondering about copyright issues lately.

Consider when you take the head of a celebrity and chop it onto the body of some guy sitting on a toilet, whose picture you find on Google. Now you probably are making a legitimate parody by poking fun at the celebrity, but what about the guy who put his toilet photo on the net? Are you infringing his copyright?

Or what if you find a picture on Google of a guy wearing a really funny hat, so you just take his hat and put it on the celebrity? Are you infringing that guys copyright by stealing his hat?

And here's an interesting quote from the second link: According to the Copyright Office, fair use does protect "use in a parody of some of the content of the work parodied." But there are two things to remember. First, the use must be a legitimate parody of the prior work. For example, using images of Barbie to parody Barbie is a fair use. Using images of Barbie to make a statement about society in general, where another doll would do just as well, is not. Second, parody is a form of cultural criticism, but not every cultural criticism is a parody. Is the usage truly a parody? Would a court agree? Think hard about that before relying on parody to protect your work.

I recently am more interested in copyright issues than I have been in the past.

I searched the FN forum and this is what came up in 2006.

What are the present 'rules' for use of photos that are any different than what was posted in this very old link?
Oh, I AM going to READ the links provided right now, but I would appreciate more up to date links on same.

Thanks in advance. It is a topic that will never completely go away.

PS When I posted I noted that my date of coming to the site (under my name) no longer reflects the correct date. Computer glitch???

I am also interested by copyright information. I am new and it's not always easy to know what it is possible to do with images.
