Drag and Drop

I have changed from cs4 to cs6 and don't like the way the files are opening. It may just be a matter of setting it up the way I want it to or it may be a change in the two versions.
In cs4 I could drag and drop a pic from my desktop to photoshop and it would open it in a new tab. Now it seems to open it as a new layer in the tab that I have open. Is there a way to change it to open it in it's own new tab. And yes in preferences ] interface I have checked the "Open Documents as Tabs". I sure thought that would have done it.

OK I figured it out. So I'll post it here just in case ...
When I drag the new pic into Photoshop If I drop it into the open window it will paste it as a new layer. If I drop it up in the title bar it will paste it as a new tab.
